GB News Terms of Use

Welcome to the GB News website and app (the "Service"). The Service includes anything made available on our website and application, including features, functionalities, user interfaces, and any other content (such as comments, articles, games, graphics, software, video clips, programmes and channels) (“Content”).
Please read these terms before accessing, installing or using the Service. They set out the agreement between you and us for your access to and use of the Service. By accessing, installing or using the Service you agree to these Terms of Use. If you don't agree to them, please don't use the Service.
Who we are: The Service is operated and provided to you by GB News Limited (company number: 12859339), whose registered office is at 2 Swan Lane, London, United Kingdom, EC4R 3TT. (“GB News”, "we", "us, "our").
Privacy: We are committed to protecting your privacy. We will collect and use personal data supplied by you and other users of our Service in accordance with our privacy policy. Our cookie policy sets out information about the cookies on our Service.
1. Registration
- You can access, use and install the Service free of charge, but some features (such as comments on our website) may only be available to you if you register an account or to become a GB News Member ("GB News Account").
- You must be [18] years or older to register a GB News Account, and must only register for one GB News Account. When creating your GB News Account, you must provide true, accurate and complete information to us.
- You are responsible for your GB News Account username and password, for keeping them confidential, and for all activities that are carried out under them (including any comments you post, and all other access to and use of the Service through your GB News Account). We recommend that you do not reveal your username and password to any other person. You agree to notify us immediately if you become aware of or suspect any breach of security or unauthorised use of your password or username.
- If you register to become a GB News Member in addition to these Terms of Use you also agree to our Membership Rules.
2. Using our Service
- By accessing, using or installing the Service, you will be able to access, use, view and interact with Content, on the terms and conditions set out in these Terms of Use.
- You confirm that, you will at all times comply with these Terms of Use and you will not use the Service for any unlawful purpose or in a way which infringes the rights of anyone else, including any intellectual property rights.
- You are permitted to use and view the Service for your personal and non-commercial use only. While you are using the Service, we grant you a limited, non-exclusive, non-transferable, licence to use and access the Service, and to access, stream and view the Content. Except for the limited licence granted to you in these Terms of Use, no right, title or interest in the Service shall be transferred to you.
- You must not, and must not allow third parties to:
- transmit, broadcast, display, perform, publish, license, offer for sale, make and/or distribute copies of any part of the Service for the benefit of any third party, or exhibit any of the Service in any public place;
- frame any item of Content or the Service, or incorporate any part of the Service into another website, application, online service, platform or video service;
- access or view any part of the Service using a virtual proxy network;
- use your username and password to access your GB News Account without authorisation;
- attempt to alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Service, unless you have a legal right to do so;
- remove, deactivate, degrade or thwart any of the content protections in the Service or the Content; or
- collect or harvest any personal data of any user of the Service (including any account name) or use any robot, bot, scraper, site search/retrieval application, proxy or other manual or automatic device, method, system or process to access, retrieve, index, “data mine”, or in any way reproduce or circumvent the navigational structure or presentation of the Service or the Content.
- You are responsible for all internet access, mobile data or other charges incurred when using the Service. Remember that streaming audio-visual content such as videos and articles can use up a lot of data.
3. Your Content
- If you have a GB News Account, you may be able to interact with Content on the Service, including leaving comments on our website. You agree that you will not submit, post or transmit on or through the Service any material that:
- is defamatory, offensive, unlawful, threatening, abusive, harassing, flaming (ie user invites or perpetuates arguments or conflict), defamatory, libellous, deceptive, fraudulent, invasive of another’s privacy, tortuous, contains explicit or graphic descriptions or accounts of sexual acts, or is otherwise objectionable;
- infringes the rights of anyone else (including, without limitation, patent, trademark, trade secret, copyright, publicity, privacy or other proprietary rights) or is in breach of these Terms of Use, any of our guidelines or any policy posted on the Service, or interferes with the use of the Service by others;
- impersonates any person, business or entity, or falsely states or otherwise misrepresents your affiliation with any person, business or entity;
- is spam or contains any virus or similar misuse of information technology;
- flooding comments or discussions with excessive posts, discussions off topic, or repetitive or complaints;
- contains an advertisement or solicitation or encourages others to make a donation; or
- encourages conduct that would constitute a criminal offence or that gives rise to civil liability or that otherwise encourages others to commit illegal activities or cause injury or property damage to any other person.
- We reserve the right (but shall have no obligation) to decide whether your Content complies with the requirements set out in these Terms of Use and may remove, modify or delete such Content, terminate or suspend your access for uploading Content and/or terminate or suspend your GB News Account without prior notice, on becoming aware of any violation of these Terms of Use, or for legal or other reasons. Notwithstanding such right of ours, users are solely responsible for the content of their material. You acknowledge and agree that neither we, nor any of our affiliates, assume or have any liability for any action or inaction by us with respect to any conduct within the Service or any communication or posting on the Service. We also reserves our right to disclose any information that we believe necessary to satisfy any law, regulation or governmental request, or to refuse to post or to remove any information or materials, in whole or in part.
- When you upload or post any material to the Service, you grant to us a worldwide, non-exclusive, transferable licence (with the right to sub-licence) to use, reproduce, distribute, modify, prepare derivative works of, display, publish and perform and sub-license all aspects of that material that are necessary for the provision of the Service. You confirm and agree that we may publish, republish or otherwise transmit your material and your name and likeness throughout the world via GB News branded websites, apps and on community and social media sites, including (without limitation) YouTube, Facebook, Twitter and Instagram pages operated by us. You agree that your material may be subject to minor alterations or modifications for technical or formatting purposes.
4. Reporting Content
- If you see any Content on the Service you want to flag or report to us because you believe it breaches these Terms of Use, including suspected infringement of another person’s intellectual property rights, please email community@gbnews.uk
- You must not abuse this email community@gbnews.uk e.g. by making malicious or false reports.
5. Ownership of Content
- With the exception of content submitted to the Service by you, Content on the Service is either owned by or licensed to us, and is subject to copyright, trade mark rights, and other intellectual property rights. You therefore have no intellectual property rights in, or to, any part of the Service, other than the right to use it in accordance with these Terms of Use. You may not remove, alter or in any way tamper with any copyright notices or other proprietary markings included in the Service or any Content.
- Trademark UK00003530998 is a pending trademark of GB News Limited. You are not permitted to use this trademark without our approval. Other product and company names mentioned on our Service may be the trademarks or registered trademarks of their respective owners.
- Any copying, access, transfer, public performance or communication to the public or other use of any part of the Service (including any Content) other than as expressly authorised by these Terms of Use shall constitute an infringement of our (or the owner’s) intellectual property rights and a breach of these Terms of Use. In the event of any such infringement, we, or one of our affiliated companies, may terminate the agreement with immediate effect, and block your access to the Service and/or terminate any GB News Account you may have and pursue any rights or remedies available to us.
6. Ending your right to use the Service
- We will endeavour to allow uninterrupted access to our Service, but we can end our agreement with you (and consequently end your right to use the Service) at any time. We may also decide to discontinue all or any part of the Service at any time.
- In addition, we may immediately end or suspend your right to use all or any part of the Service (including restricting access to your GB News Account) if you have seriously breached these Terms of Use or if you are using any part of the Service fraudulently, illegally or in any manner other than for its intended purpose.
- If we end your rights to use the Service or your GB News Account you must stop all activities authorised by these Terms of Use, including your use of the Service. All disclaimers, indemnities and exclusions in these terms and conditions shall survive termination of the agreement between us for any reason.
7. Cancellation
You can stop using the Service and/or cancel your GB News Account at any time in accordance with these Terms of Use or where applicable the Membership Rules. Any request to cancel any of our services or to stop receiving communications from us may be made via email to community@gbnews.uk.
8. Device restrictions, supported devices and updates
- Availability and functionality of the Service and Content depends on the quality of your internet connection and device capabilities. Some features of the Service may not be available on all devices or on all operating systems. [Please visit our Website to see the full list of supported devices and operating system requirements.]
- To get the best experience and to ensure the Service operates correctly, we recommend that you accept any updates to the Service as and when they become available. This may also require you to update your device operating system. As and when new operating systems and devices are released, we may over time stop supporting older versions. - Your use of any updates, modifications to, or replacement versions of the Service will be governed by these Terms of Use and any additional terms you agree to when you install such update, modification, or replacement version.
9. Our liability to you
- You have certain legal rights under the laws of your territory. Nothing in these Terms of Use is intended to affect these legal rights and we do not exclude our liability where we are not permitted to do so under the laws of your territory.
- We accept liability for death or personal injury caused by our negligence or that of our employees and agents. We are also liable for fraud and fraudulent misrepresentation by us or our employees or agents.
- If we breach these Terms of Use we will only be liable for losses which are foreseeable. Losses are foreseeable where they are obvious, or both you and GB News knew they might happen at the time of you agreeing to these Terms of Use.
- We are not responsible for:
- any use by you of the Service or Content which isn’t authorised by us under these Terms of Use, including any business losses (such as loss of profit or interruption to your business);
- any malfunction or interruption to the Service or Content due to circumstances outside of our control that prevent us from fulfilling our obligations to you;
- any lack of functionality or failure to provide any part of the Service or the Content, or any loss of content or data that is due to:
- your equipment, devices, operating system or internet connection (including malware, viruses or bugs originating from third parties or on any of your devices);
- your failure to download any update or the most recent published version of the Service, or to meet the compatibility requirements; or
- the consequences of you changing your equipment, device, operating system or internet connection;
- incompatibility of any part of the Service or Content with any other software or hardware (including any of your devices); and
- We can't guarantee that the Service or the Content will be entirely free from bugs or errors or that your access will be free from interruptions (for example there may be downtime for maintenance or updates or any power or server outages or other reasons outside our control), however where we are made aware of technical issues then we will always try to fix them.
- Other than as set out above, GB News (including without limitation any officer, employee, consultant, agent, shareholder, director of GB News) shall not be liable for any loss or damage suffered by any person or other entity in connection with the Service, the Content or any other basis upon which such party shall interact with GB News, whether direct or indirect and including without limitation any loss arising in connection with any goodwill, business, profit, saving or data howsoever arising and whether caused by breach of contract, tort or otherwise save for any liability specifically accepted above or that cannot be excluded or limited under any relevant law.
10. Advertising and third party websites
- The Service and Content may contain third party advertisements. Each advertiser is responsible for the content, accuracy and completeness of such advertisements and we are not liable to you for any reliance placed by you on any such advertising or for any mistakes, omissions or inaccuracies contained therein.
- The Service may include hyperlinks to other websites that are not owned or controlled by us. We have no control over, and assume no responsibility for, the availability, content, privacy policies, or practices of any third party websites. You acknowledge and agree that:
- we will not be liable for any loss or damage which may be incurred by you as a result of the availability of those external third party sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such websites or resources; and
- you agree that you will not involve us in any dispute between you and the third party.
- We encourage you to be aware when you leave the Service and to read the terms and conditions and privacy policy of each other website that you visit.
11. Changes to the Service and Content
- The Content on the Service will change regularly – that means events, articles and programmes may become available whilst other events, articles and programmes will stop being available. The availability of Content may change for various reasons, such as where third party rights-holders withdraw or restrict our right to use that content on the Service, for legal or regulatory reasons or for other reasons beyond our reasonable control. We therefore have the right to add, change or withdraw Content at any time, with or without notice.
- We may make changes to, suspend or discontinue the Service (or any part of the Service) at any time without giving you any notice. Such changes may be made (for example): when we have to remove certain features or functionality and/or stop allowing certain devices or platforms from being able to access the Service. We may also improve, update or enhance the Service from time to time.
12. Changes to these Terms of Use
- We have the right to change these Terms of Use at any time for the following reasons:
- to improve the Terms of Use, to make them clearer or easier to understand or to have all our customers on the same Terms of Use;
- to comply with legal or regulatory requirements, such as mandatory laws that apply to us and our agreement with you, or where we are subject to a court order or judgment;
- where we make changes to the Service in order to improve it, including where we expand the scope of the Service by adding additional features, functionality or Content;
- we intend to change the way we structure our Service or we reorganise the way we structure or run our business, including to add paid subscriptions, memberships or similar changes; or
- for security reasons, including where we introduce additional security checks or software to protect our Content or the Service
In addition, we are constantly striving to improve our Service and we cannot foresee what may change in the future. This means we may make changes or additions to these Terms of Use for reasons other than those set out above.
- We will try to provide reasonable advance notice of any material changes to these Terms of Use which may disadvantage you. Please check back from time to time to see if any changes have been made to these Terms of Use. If you do not agree to the modified Terms of Use you must stop using the Service. Your continued use of the Service will be deemed to constitute your acceptance to any such changes.
- The most up to date version of the Terms of Use will always be available on our website and app from their effective date.
13. Competitions and prize draws
From time to time, we may run promotions, competitions and/or prize draws ("Promotions") on the Service. Promotions may have their own terms and conditions, which will be made clear to you before you take part in such Promotion.
14. Membership, Donations and Gifts
There are a number of ways in which you can help support the invaluable work that we do. Further details of the ways in which you can help are set out below.
Membership
We offer a number of different ways for you to become a GB News member. For further information and details please see our Membership sign up page and our Membership Rules.
Gifts
In addition to becoming a member of the GB News community, we also offer the ability for you to gift membership to someone else here. This is a great way to show your support for us and introduce other like minded people to the selected benefits of Britain’s News Channel.
The making any gift of membership shall take place in accordance with the rules, terms and conditions applying to donations below.
In addition, anyone receiving membership as a gift will need to register themselves and agree to our Membership Rules, Privacy Policy and Terms of Use, all of which can be found here or at the point of sign up.
Donations
GB News welcomes donations in order to support its invaluable work as the home of the people’s news channel. To make a donation please use our donation link which may be found here. The provisions set out in the remainder of this clause 14 apply to donations.
- We are pleased to accept voluntary donations from individuals and organisations (a “donor"). The making of a donation does not form a contract between us and a donor unless or until we accept the donation, at which point the terms and conditions set out below will apply. By making a donation a donor agrees that they will be bound by these terms.
- All donors (as individuals) must be aged 18 or over. All donations must be made from funds owned by the donor and by making a donation the donor warrants that: all funds donated are legally able to be donated to us and that the donation will not, nor will it be used for, the purposes of damaging the reputation of, embarrassing, seeking to denigrate or disparage GB News, and that by accepting the donation GB News will not be caused any loss or damage.
- Any funds donated may be used by us in any manner at our discretion to support the work of GB News. Donors may not exercise any influence over editorial (or any other) GB News policy. Donations may be made using GB News payment service providers from time to time and subject to the terms of such payment provider. If any donor wishes to make a donation in excess of £5,000 (whether as a one off or by a number of donations in a 12 month period), please contact us at community@gbnews.uk and provide a telephone number so that we can telephone you to discuss your donation.
- Any donation once paid to us is non-returnable and non-refundable, save that we may at our discretion and/or in accordance with these terms refuse to accept any donation and return funds, including where we consider that any donation (including having regard to the source of the donation or identity of the donor) is incompatible with GB News values or interests, has been made in bad faith or where it might damage the relationship between GB News and its various stakeholders. GB News is not a registered charity and accordingly donations do not attract tax relief or “gift aid” or any similar benefit. It is a condition of any donation that the donor agrees to provide full contact / personal details or any other information that we may request in connection with the donation, including information to enable us to verify the source of funds and the identity of the donor.
- Donors shall not be entitled to publicise or publish the fact that they have made a donation other than with our consent. All donations are subject to the GB News privacy policy (which may be found here) and are confidential, however, the donor agrees that we may from time to time at our discretion publicise the identity of any or some of our donors.
- GB News (including without limitation any officer, employee, consultant, agent, shareholder, director of GB News) shall not be liable for any loss or damage suffered by any donor or other person in connection with a donation or gift, whether direct or indirect and including without limitation any loss arising in connection with any goodwill, business, profit, saving or data howsoever arising and whether caused by breach of contract, tort or otherwise save for any liability for death or personal injury or any other loss or liability that cannot be excluded or limited under any relevant law. No one other than the donor has or may acquire any legal rights in connection with a donation.
- The terms and any non-contractual obligations arising in relation to a donation or gift are governed by English Law and subject to the non-exclusive jurisdiction of the Courts of England and Wales.

15. Other terms
- Transfer of rights: The agreement between us and you is personal to you and no third party is entitled to benefit under it. We can transfer our rights and obligations under these Terms of Use to any company, firm or person provided that your GB News Account will not be adversely affected as a result of such transfer. You may not transfer your rights or obligations under these Terms of Use to anyone else.
- Severance: If any paragraph or section of these Terms of Use is held to be unlawful, invalid or unenforceable by a court or legal authority, that paragraph or section shall be treated as removed. The validity and enforceability of the remaining parts of these Terms of Use shall continue and will not be affected.
- Waiver: To the extent we fail to or decide not to exercise any right of claim against you to which we are entitled, this will not constitute a waiver of that right unless otherwise indicated to you in writing.
- Governing law and jurisdiction: These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales. However, these Terms of Use will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence. If you live in the UK, you will only be able to bring a claim related to or arising from these Terms of Use in the courts of England and Wales. If you do not live in the UK, you can bring a claim in the courts of your territory of residence
- Answer the promoted yes or no question by sending GBYES (Yes) or GBNO (No) to 63333. Texts cost 50p plus your standard network rate.
- Users of the service must be 18 or over and have the bill payer’s permission.
- Votes are open to UK residents only.
- Votes sent outside of the vote window will not be counted but may be charged.
- The only way to vote is via SMS message.
- Multiple votes are permitted.
- If you enter a vote, we may send you SMS marketing messages relating to the vote which are free to receive. If you do not wish to receive further messages, there will be an opportunity to opt out as detailed in the text message(s) you will receive.
- For queries, the customer helpline number is 0333 202 3390 (cost national rate).
- The result to the vote will be announced on air after the end of the vote window.
- If you are watching on catch-up your votes won’t be counted but you may still be charged.
