Samantha Markle's attorney has made a significant legal blunder by repeatedly referring to Prince Harry as the "Prince of Wales" in court documents, a title that belongs to his brother Prince William.

The error appears nine times in recent filings at the Court of Appeals for the 11th Circuit, where Samantha is pursuing a libel case against her half-sister Meghan, Duchess of Sussex.


The documents incorrectly describe Harry as "Prince of Wales" in multiple references to his relationship with Meghan and their media ventures.

Prince Harry, born "Prince Henry of Wales," has never held the "Prince of Wales" title, traditionally reserved for the heir apparent to the British throne.

One court filing by Samantha's lawyers stated: "Amidst the ongoing publicity of their fairytale engagement and wedding, and subsequent fallout with the 'Royals,' Meghan started a production studio, Archewell Productions with her husband, Harry, Prince of Wales."

Another passage erroneously claimed: "The 6-part Series delved into the inner lives of Meghan and her husband, Harry, Prince of Wales, discussing everything from their early lives to their wedding and eventual fallout with the Royal Family."

The documents also incorrectly noted: "It is safe to say that prior to Meghan's engagement to Harry, Prince of Wales, the world at large never heard of Samantha Markle."

These mistakes contrast starkly with Meghan's legal team's filings, which correctly refer to Harry as "Prince Henry of Wales."

The Prince of Wales title is currently held by Prince William, who is next in line to the British throne.

Before Queen Elizabeth II's death, King Charles III held the title, while Princess Diana was known as the Princess of Wales during her lifetime.

Princess Kate now holds the title of Princess of Wales, following her husband William's appointment as Prince of Wales.

The confusion in the court documents highlights the significance of royal titles within the British monarchy, where specific designations are reserved for particular roles in the line of succession.

While retaining his Duke of Sussex title, Prince Harry has never been Prince of Wales, as this prestigious title is specifically reserved for the heir apparent to the British throne.

The case is currently before the Court of Appeals for the 11th Circuit after Samantha's initial defeat at the Federal Court in the Middle District of Florida.

The title dispute extends beyond Harry's designation, with ongoing disagreements about how Meghan should be referred to in court documents.

Samantha filed her lawsuit against "Meghan Markle," using her half-sister's maiden name.

Meghan's legal team has consistently pushed back, emphasising her proper title as the Duchess of Sussex.

In September, her lawyers notably described her as "The Duchess of Sussex (erroneously sued as 'Meghan Markle')."

Judge Charlene Edwards Honeywell, who dismissed the original case, acknowledged both forms, writing: "Samantha M. Markle is a citizen of Florida and half-sister to Meghan Markle, also known as Meghan, the Duchess of Sussex."
