The Heritage Foundation has filed a second lawsuit to obtain Prince Harry's immigration records, claiming he may have lied about drug use on his visa forms.

The right-wing think tank is pursuing the release of the Duke of Sussex's paperwork after heavily redacted documents were released earlier this week by the Department of Homeland Security.


The case is expected to continue for months, potentially causing further anxiety for Harry.

Samuel Dewey, a lawyer with the Heritage Foundation, told the Mail that Prince Harry should "self-deport" from the US because he "hates America".

Dewey claimed the Duke was "furious" at American voters for electing Donald Trump in the 2024 election.

"If he dislikes the President, Harry should just 'go home' back to the UK," Dewey told the outlet.

Dewey revealed that documents released this week showed a "mismatch" between DHS and State Department files, giving the Foundation a new "working theory".

The lawyer suggested Harry may be in the US on an O-1 visa, also known as the "artist visa".

He believes the Duke may have lied on the paperwork about his drug use.

The documents were released after a judge reviewed them in an in-camera hearing last April.

Dewey argued that aside from paperwork issues, the Duke "really ought to go" from America after repeatedly criticising Trump.

"He's in a country he clearly hates," the lawyer claimed. "He's clearly furious at the American voters and attacking them for the result of the 2024 election."

Dewey referenced Harry's recent thinly veiled jibe about "weak moral character in the world" as evidence of his criticism of Trump.

Heritage's lawsuit against DHS lasted two years before six heavily redacted documents were released on Tuesday.

The think tank argued that Harry admitted repeated drug use in his 2023 memoir "Spare" and his Netflix TV series. This included using cannabis, cocaine and magic mushrooms.

Had the Duke mentioned that on his immigration forms when he moved to the US in 2020, he could have been denied entry or faced further questioning.

The latest lawsuit was filed at the federal court in the District of Columbia and is being overseen by the same judge as the first one, Judge Carl Nichols.

In court documents, Heritage claims that the Department of State has failed to respond to its FOIA request promptly.

The request was submitted on September 24 last year and asks for all records related to Prince Harry from January 2020 to the present. This includes reports, text messages, emails, notes and intra-office communications.

After the release of the DHS records, Nile Gardiner from Heritage told GB News he would continue the fight for Harry's visa documents to be released.
