A neighbour was handed a Community Protection Warning (CPW) from the council after they received complaints that he was engaging in “excessive bird feeding”.
Fylde Council gave the man, named as Mr X, the notice after they said they received evidence that his bird feed was attracting large flocks to the area. They advised him to stop leaving food out.
The complaint was lodged by a neighbour, who Mr X says has been engaging in some unsavoury behaviour himself.
He has claimed that the individual had threatened himself and others, taken photographs of them without their consent, and has been peering into their windows.

Mr X flagged the anti-social behaviour of the neighbour to the local authority with repeated letters, but claims that he was ignored.
The council did however continue to contact him regarding his bird feeding, as more complaints were lodged.
It conceded that whilst feeding wildlife is not illegal, it can result in disturbances which could anger his neighbours.
In response, Mr X replied that his own complaints about the neighbour were not being listened to.

He reiterated that the man was engaging in threatening behaviour, such as banging on bin lids, playing loud music, and taking pictures of his home.
After two visits to Mr X’s property to discuss the bird feeding, both of which he did not answer the door, the local authority issued a CPW.
Fylde Council contacted Mr X to apologise for not responding to his letters regarding his neighbour and said that he should email them if the threatening behaviour from the individual continued, expressing a willingness to help.
However, for Mr X, it was too little too late, stating that he felt his neighbour was receiving preferable treatment by the council.

He filed a complaint against them to an ombudsman.
The neighbour was ultimately also given a CPW, asking them to cease any behaviour that could be seen as harassment.
Whilst the Local Government and Social Care Ombudsman decided not to take any action against the council, Mr X has received an appropriate remedy for their preferential treatment.
