An Egyptian doctor in Britain who mocked Israelis for fleeing Hamas terrorists during the October 7 attacks has had her deportation order overturned by a judge.

Dr Mennah Elwan was working at an NHS trust in Liverpool during the terrorist attacks on Israel in 2023 - in which more than 1,100 people were killed and hundreds were taken hostage.


Just hours after the slaughter, the NHS employee wrote on social media: "If it was ur home, u would stay and fight - you wouldn't just run away," alongside a smiling emoji to the post.

In another post, Elwan said "there are no civilians in Israel".

She was referred to then-Home Secretary James Cleverly, who moved to revoke her temporary right to remain in the UK.

In a letter explaining the decision, Home Office officials told Elwan that Cleverly was "satisfied that your continued presence in the UK would not be conducive to the public good".

It said that in his view, Elwan had "made public posts which supported an act of terrorism which is considered to be conduct which is non-conducive to the public good... [and] which also engages the criteria for extremism or unacceptable behaviour".

Officials also stressed that the move to deport the doctor did not breach her human rights - and her permission to stay was "cancelled with immediate effect".

Elwan then appealed the decision, with her legal team arguing that Cleverly's decision to revoke her right to remain in Britain had indeed breached her rights to "freedom of expression and family life", which are protected under the European Convention on Human Rights (ECHR).

A judge at an immigration and asylum tribunal in Manchester has now overturned Cleverly's decision - and has said Elwan's case should be reviewed by his successor Yvette Cooper.

In his ruling, Judge Stephen Davies said the "reasonable and proportionate reaction" to Elwan's comments about the Hamas attacks would have been to let her stay in the UK on her existing visa - but on the condition that "she would receive a clear warning that her posts were unacceptable".

Davies added that the doctor should have been warned that, if she repeated such behaviour, the Home Secretary would be within their right to review her status in the country.

Davies claimed the option to warn Elwan did "not appear even to have been considered" by Cleverly at the time - because of what he called an "all-or-nothing" approach by the Home Office.

The overturning is just the latest in a series of increasingly controversial moves by Britain's judiciary under the ECHR.

Just yesterday, it came to light that immigration judges declared a Sudanese "asylum seeker" was a child - in the face of a Home Office assessment that he was at least 23 years old, had a receding hairline and thick facial hair.

A few days prior, Palestinian migrants were granted the right to live in Britain after applying through a scheme meant for Ukrainian refugees.
